    Ms. Guerra began her career with the EEOC’s Houston District Office in 1999 as an investigator, a role she held for 16 years before being promoted to an Enforcement Supervisor.

    In 2020, Marina stepped into her current role in Outreach and Education, where she brings her extensive experience and passion for helping employers, employees and communities understand and uphold workplace rights. Known for her commitment, knowledge and heart for service, Marina is driven by a genuine passion to prevent and remedy unlawful discrimination to achieve fair and inclusive workplaces for all.

    "Blurred Lines: When Online Conduct
      Becomes a Workplace Issue"

    Social media has changed the way employees communicate and the way harassment shows up in the workplace. From viral posts, group chats, and off duty conduct, HR professionals are navigating situations that might begin outside the office but can quickly impact it.

    In this session we will explore when online and off duty conduct may trigger employer obligations and discuss practical strategies of responding effectively to mitigate risk.

    Participant Learning Objectives:

    • Discover how social media harassment and online conduct may intersect with EEOC compliance

    • Realize when off-duty or online behavior may be an employer’s responsibility to address and resolve

    • Understand employer obligations once they become aware of harassment in the workplace

        "A Look at ‘Modern’
          Sex Discrimination Claims"

        The way that the current EEOC and administration is viewing sex discrimination claims is different than in previous years. We’re seeing lots of new updates to enforcement of reverse discrimination claims, pregnancy accommodations, DEI, and other areas of sex discrimination that require big changes from employers to ensure compliance.

        This presentation will discuss all recent changes including recent EEOC enforcement and examples, as well as practical advice for how to keep up with these changes (and what to expect for the future).

        Participant Learning Objectives:

        • Learn about recent EEOC litigation and enforcement efforts from EEOC

        • Understand new concept of “reverse discrimination” and how to avoid these types of claims

        • Receive practical advice about policies to change in light of new effects of PWFA

        • Discuss federal regulations regarding DEI procedures

Her practice includes advising employers during OSHA inspections and investigations, contesting OSHA citations, and defending employers against OSHA whistleblower and retaliation claims.
