Mental health and mental health disabilities are at the forefront of employees’ minds in today’s society. But for these harder-to-see disabilities, how does an employer know when they are on “notice” that they must enter into the interactive process.
If an employee says they’re feeling anxious, does that trigger an employer’s duty to act? We will discuss with recent caselaw and examples as well as talk through strategies for accommodation.

- Understand the legalities of the Americans with Disabilities Act and employers’ duties under the Act
- Discuss the boundaries of what is a “mental health disability”
- Strategize methods of accommodation for mental health disabilities
HALEY KURISKY is an associate in the Houston office of Jackson Lewis P.C., a full service labor and employment firm with offices across the country. Haley is a native Houstonian. She attended Rice University for her undergraduate degree and the University of Houston Law Center for her juris doctorate.
Haley gained an interest in employment law after interning for the Honorable Judge Lynn Hughes in the Southern District of Texas and for the Houston office of the Equal Employment Opportunity Commission.
