More often than not, what gets employers in trouble after they’ve disciplined or discharged an employee is not a bad intent, but rather, leaving the door cracked that there might have been an illegal motivation behind the decision because the process wasn’t done right.

This presentation will examine the do’s and don’ts of how to effectuate a disciplinary or discharge decision that minimizes the possibility of creating a legal claim.

Participant Learning Objectives:

  • Explore the fundamentals of decision-making as it relates to employee discipline / discharge
  • Identify essential elements to determine whether to discipline or discharge an employee
  • Learn “why” it is so important to “do it right”

Joseph G. (Chip) Galagaza, Senior Counsel is a Board Certified Labor and Employment lawyer with over 40 years representing management in virtually every aspect of the practice area - from providing advice and counsel to being an advocate before administrative agencies and in the courthouse and before appellate courts. Chip has also recently added being a mediator and arbitrator of labor and employment law disputes as a part of his practice.

Kelly S. Sullivan, Senior Counsel has practiced over 20 years with over 15 years of her practice focusing on advising employers and representing them before administrative agencies and in the courts on labor and employment law matters. Kelly has also practiced both as outside counsel with law firms and as an in-house attorney, and her experience as a General Counsel gives her a unique and valuable perspective in assisting her employment law clients.
